If your organization has employees in Washington State, you have an active compliance obligation right now. The WA Cares Fund is not pending -- it's already deducting 0.58 percent of wages from every W-2 employee who doesn't have a qualifying private LTC plan on file.
That payroll deduction is uncapped. There's no income ceiling. A Washington employee earning $200,000 a year loses $1,160. An employee earning $500,000 loses $2,900. Every year. Permanently -- unless a qualifying plan is in place.
Here's what HR needs to do.
First, identify every W-2 employee your organization has in Washington State. These are the employees subject to the deduction.
Second, understand the exemption process. Employees who obtain a qualifying private LTC plan can file with the Washington Employment Security Department to opt out of the WA Cares Fund deduction permanently. The plan must meet specific state criteria -- not every LTC policy qualifies.
Third, communicate the option to your Washington employees. Many don't know the exemption exists. HR is responsible for getting that information in front of them in time to act.
